Terms of Service

1. Purpose

These Terms of Service (hereinafter "Terms") define the conditions of use of the Fournil application (hereinafter "the Service"), published by Mathieu Piton, sole proprietor.

Any registration or use of the Service implies unreserved acceptance of these Terms.

2. Access to the Service

The Service is accessible via the web application at https://fournil.app and via the Fournil Caisse mobile app.

To access the Service, the User must:

  • Be a natural or legal person operating a bakery, pastry shop, or artisan food business
  • Create an account by providing a valid email address
  • Accept these Terms

Access to the Service requires an Internet connection. The mobile app includes an offline mode enabling continued POS operations without connectivity.

3. Description of the Service

Fournil is an all-in-one management application for artisan bakeries. The Service includes:

  • Point of Sale: sales processing with offline mode support
  • Catalog management: products, categories, and pricing
  • Sales tracking: history, statistics, and reports
  • Team management: roles and permissions for staff
  • Synchronization: automatic data sync across devices

The Service is offered free of charge. Premium features may be offered in the future under separate terms.

4. User Obligations

The User agrees to:

  • Provide accurate information during registration and keep it up to date
  • Maintain the confidentiality of login credentials and not share them with unauthorized third parties
  • Use the Service in accordance with its intended purpose and applicable laws
  • Not attempt to interfere with the proper functioning of the Service
  • Not use the Service for unlawful purposes
  • Respect the intellectual property rights of the publisher

The User is solely responsible for the accuracy of data entered into the Service, including accounting and commercial information.

5. Data Ownership

The User retains ownership of all data entered into the Service (products, sales, customer information, accounting data).

The publisher commits to:

  • Not use User data for commercial or advertising purposes
  • Not sell, rent, or transfer data to third parties, except as required by law
  • Enable data export in a standard format (in accordance with GDPR data portability rights)
  • Delete data within 30 days of the User's request, subject to legal retention obligations

Personal data processing is detailed in the Privacy Policy.

6. Service Availability

The publisher strives to keep the Service available 24/7.

However, the publisher cannot guarantee permanent availability and shall not be held liable for interruptions due to:

  • Maintenance, updates, or improvements to the Service
  • Technical issues beyond its control (hosting outages, network failures)
  • Force majeure events

The mobile app includes an offline mode ensuring continuity of POS operations even during online Service interruptions.

7. Limitation of Liability

The Service is provided "as is". The publisher shall not be held liable for:

  • Direct or indirect damages resulting from the use or inability to use the Service
  • Data loss due to technical malfunction, except in cases of proven publisher fault
  • Commercial or accounting decisions made by the User based on information provided by the Service
  • Non-compliant use of the Service by the User

In any event, the publisher's liability is limited to the amounts actually paid by the User during the 12 months preceding the event giving rise to liability.

8. Termination

By the User: The User may terminate their account at any time by contacting support at [email protected]. Termination results in account and data deletion within 30 days, subject to legal retention obligations.

By the publisher: The publisher reserves the right to suspend or terminate access to the Service without notice in cases of:

  • Violation of these Terms
  • Fraudulent or abusive use of the Service
  • Non-compliance with legal obligations by the User

Upon termination, the User retains the right to export their data for 30 days following notification.

9. Changes to Terms

The publisher reserves the right to modify these Terms at any time. Changes take effect upon publication on the website.

The User will be notified of any substantial changes by email. Continued use of the Service after notification constitutes acceptance of the new Terms.

In case of disagreement with the changes, the User may terminate their account as provided in Section 8.

10. Governing Law and Jurisdiction

These Terms are governed by French law.

In the event of a dispute, the parties agree to seek an amicable solution before any legal action.

Failing amicable agreement within 30 days, any dispute shall be submitted to the competent courts of the publisher's jurisdiction.
